9.0 Validation disputes

9.1 In line with the National Planning Practice Guidance, if you disagree with the reasons given for invalidating your planning application you should first raise this with the local planning authority and every effort should be made between both parties to resolve the disagreement. You should raise any disagreement by emailing planning@centralbedfordshire.gov.uk setting out your reasons for disagreeing. This information will be reviewed.

9.2 If, following review there is still no agreement, you must first send a notice to us under Article 12 of the Town and Country Planning (Development Management Procedure) (England) Order 2015 (known as an Article 12 notice). This must set out the reasons why you consider the information requested by the local planning authority, in refusing to validate the application, does not meet the statutory tests.             

9.3 We must respond to the notice within the statutory time period for determining the application in question. The timescales for this process are as follows:

  • 16 weeks for applications subject to an Environmental Impact Assessment (EIA)
  • 13 weeks for applications for major developments
  • 8 weeks for all other development types.

9.4 We will then consider your case as to why the information requested does not meet the statutory tests. We must then issue either a 'validation notice' or 'non-validation notice'. If, we issue a validation notice, we are stating that the information is no longer required. If, we issue a non-validation notice then we are stating that we still require the information requested.

9.5 If you receive a non-validation notice, then after the relevant time period set out above, you can appeal to the Planning Inspectorate against non-determination. In such cases, the statutory time period will have begun on the date we have received the fee, documents and other information necessary to validate the application, but excluding the disputed information.
